Agreement
By using Cargo Mode, you agree to these terms. If you don't agree, please don't use our service.
What We Provide
Cargo Mode is a freight forwarding automation platform that:
- Processes shipping documents using AI and OCR technology
- Integrates with CargoWise and carrier systems
- Automates data entry and job creation
- Provides tracking and status updates
- Offers document storage and management
Your Account
Registration
- You must provide accurate information when signing up
- One person per account (no sharing credentials)
- You're responsible for keeping your password secure
- Notify us immediately of any unauthorised access
Acceptable Use
You may only use Cargo Mode for:
- Legitimate freight forwarding and logistics operations
- Processing your own shipping documents
- Business purposes in compliance with applicable laws
You may not:
- Upload malicious files or spam content
- Attempt to hack or reverse engineer our platform
- Use our service for illegal activities
- Share or resell access to unauthorised parties
Service Availability
- We aim for 99.9% uptime but can't guarantee uninterrupted service
- Planned maintenance will be announced in advance
- We're not liable for downtime beyond our control
- Critical features have backup procedures in place
Your Data and Content
Ownership
- You own all the shipping data and documents you upload
- We don't claim ownership of your content
- You grant us permission to process your data only to provide our services
- Data Confidentiality: All your business data is strictly confidential. We implement appropriate technical and organisational measures to protect your information and never share it with third parties except as explicitly stated in our Privacy Policy
System Improvement
- We may use anonymised, aggregated data patterns to improve our algorithms
- This never includes your specific business information, customer details, or commercially sensitive data
- Individual documents and business data remain completely confidential
- You can opt out of anonymised data usage by contacting support@cargomo.de
Accuracy
- You're responsible for the accuracy of uploaded documents
- We provide OCR and data extraction as a convenience tool
- Always verify critical information before submitting to carriers or customs
- We're not liable for errors in extracted data
Backup
- We maintain regular backups of your data
- You should also keep your own copies of important documents
- We're not responsible for data loss due to your actions
Billing and Payments
Pricing
- Current pricing is available on our website and in-app
- Prices are in GBP unless otherwise stated
- We may change prices with 30 days' notice
Billing
- Subscription fees are billed monthly in advance
- Document processing charges are billed monthly in arrears
- Payment is due immediately upon invoice
- Failed payments may result in service suspension
Refunds
- Subscription fees: Prorated refunds for unused service
- Processing charges: No refunds for completed document processing
- Billing disputes must be raised within 30 days
Service Limits
Fair Usage
- 300 document processing credits included per month on standard plan
- Additional usage charged at £2-5 per document
- Bulk processing limits may apply during peak times
Storage
- Unlimited document storage included
- Files over 50MB may require compression
- Documents older than 7 years may be archived
Integrations
CargoWise
- Requires valid CargoWise licence and eAdaptor access
- We're not responsible for CargoWise connectivity issues
- Job creation accuracy depends on CargoWise configuration
Carrier APIs
- Dependent on third-party carrier system availability
- We don't guarantee real-time tracking updates
- Carrier API changes may affect functionality
Liability and Disclaimers
Service "As Is"
- Cargo Mode is provided without warranties
- We don't guarantee error-free operation
- Your use is at your own risk
Limitation of Liability
We're not liable for:
- Indirect, consequential, or punitive damages
- Lost profits or business opportunities
- Customs delays or penalties due to data errors
- Third-party service failures (CargoWise, carriers, etc.)
- Data breaches caused by your account security practices
Our total liability is limited to the amount you paid us in the 12 months before the claim.
Data Protection: We maintain strict data confidentiality and implement industry-standard security measures. However, you acknowledge that no system is 100% secure and agree that our liability for any data security incident is limited to the amount paid for services in the preceding 12 months.
Indemnification
You agree to indemnify us against claims arising from:
- Your use of the service
- Your violation of these terms
- Your violation of applicable laws or regulations
Termination
By You
- Cancel anytime with 30 days' notice
- Access continues until end of current billing period
- You can export your data before termination
By Us
We may terminate for:
- Non-payment after 30 days
- Violation of acceptable use policy
- Illegal or harmful activities
- Extended period of inactivity (12+ months)
Effect of Termination
- Service access stops immediately
- Data retained for 90 days then deleted
- Outstanding fees remain due
- Backup and restoration services end
Changes to Terms
- We may update these terms with 30 days' notice
- Continued use after changes means you accept the new terms
- Material changes will be highlighted in our notification
Governing Law
These terms are governed by:
- Laws of: England and Wales
- Jurisdiction: English courts
- Disputes: Resolved through binding arbitration where possible
